PRIVACY POLICY

The Clio Snacks Company (“Clio,” “we,” “us,” “our”) and its affiliates are committed to protecting and preserving your privacy.  This policy, together with our Terms and Conditions of Use, and any other underlying agreements or terms, sets out the basis on which any data we collect from you, or that you provide to us, will be processed by us.  By using any of our websites (“Site”), you are accepting the practices described in this Privacy Policy. This Privacy Policy also describes the manner in which we process, use and disclose information that you provide to us when you use our Site.

By using this Site, you consent to the use of the information that you provide to us in accordance with this Privacy Policy. We do update this Privacy Policy from time to time so please review this Privacy Policy regularly. If we materially alter our Privacy Policy, we will notify you of such changes by posting a notice on our Site and/or contacting you at the e-mail address provided to us. Your continued use of the Site will be deemed your agreement that your information may be used in accordance with the new policy.  If you do not agree with the changes, then you should stop using the Site, and you should notify us that you do not want your information used in accordance with the changes. 

By accessing and using the Site, you agree that you have read and understand this Privacy Policy and that you accept and consent to the privacy practices and uses and disclosures of your information as described herein.  

In order to deliver personalized and relevant information to you through our Site, we collect certain information from users. 

Information We Collect 

In operating our Site, we may collect and process the following data about you:

  1. Details of your visits to our Site and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data, including your IP address, the date and time you accessed or left the Site, and which pages you viewed. Some parts of our Site use cookies and other technologies to collect this information about your general internet usage.  See section below ‘How We Use Cookies” to learn more.

  2. Information that you provide directly to us by filling in forms on our Site, such as your name, email address and message if you use our “Contact Us” form or your email address where you sign up for our newsletter.  

  3. Information related to your order(s) if you shop our products directly on our Site, including your name, email address, company name, address, telephone number, and details of your order. We do not collect or process your payment card data. We use third-party payment processors to complete transactions through our Site.

  4. Information you provide to us when you register an account with us and/or sign up for our Clio Society/Clio Cravings Club, including your name, email address, telephone number, address, gender, marital status, household income, any other personal or preference information that you provide to us, as well as records and copies of your communications with us.

  5. We may also collect information about you from other sources, such as blogs, discussion comments, survey responses, social sharing within our Clio Society/Clio Cravings Club, and other users of our service through the operation of the service in order to provide you with more useful information and more personalized offers and experiences. We also may collect tokens or other access information that you provide us for other accounts that you associate with your Clio Society account (such as blogs, Twitter, Facebook, Instagram or Pinterest); tokens are like an electronic key provided by the services that acts in place of a password for authentication.

  6. You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site and/or through our Clio Cravings Club/Clio Society Community Platform or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

  7. Information provided to us when you communicate with us for any reason.

When you use our Site, certain information you post or share with third parties (e.g., a friend or someone in your network), such as personal information, comments, messages, photos, videos, listings or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, listings or other items, this information may become publicly available.

Please note that we do not collect and/or process payment details. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. By submitting a telephone number to Clio, you agree that a representative of Clio can contact you at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message.  Your consent is not an obligation to receive any of our products and/or services.

How We Use Cookies

A “cookie” is a piece of text which asks permission to be placed on your computer’s hard drive. Once you agree, this cookie file is stored on the hard drive of your computer.  They help us and our affiliates to improve our Site.  They present the content from our Site in the most effective manner for you and your computer.

All computers have the ability to decline cookies.  This can be done by activating the setting on your browser which enables you to decline the cookies. Please note that should you choose to decline cookies, you may be unable to access particular parts of our Site.

We do not track our users across time or across websites.

We do use flash cookies on our Site. Flash cookies are small pieces of information stored and accessed by Adobe Flash. If you want to disable these flash cookies, you’ll need to open up the Adobe Settings Manager, accessible either by right-clicking flash content and clicking “Global Settings,” or by navigating directly to your storage settings through the Flash Website. There you can clear some or all of your flash cookies manually through the Website Storage panel, or even turn off Flash Storage completely. However, please remember this could prevent some parts of our Site from working properly. 

We also use Facebook Pixel which is Facebook’s version of a cookie that tracks users online behavior on our Site. However, online behavior is only tracked through Facebook Pixel if users have opted in through their browser and/or device. You should be aware that getting a new device, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

We may also partner with selected third-party vendors, such as (e.g. Google Analytics, DataQ, and Google Data Studio) to allow tracking technologies and remarketing services on our Site through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content, and better understand online activity. These third-party service providers may use cookies or pixels to collect standard internet log information and user behavior information. The information generated by the cookie or pixel about your use of our Site (including your IP address and geo-location) is transmitted to these service providers. This information is then used by the service providers to evaluate our users’ use of our Site and to compile statistical reports on Site activity for us. By accessing the Site, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors.

Use of Your Information

The information that we collect and store relating to you is primarily used to enable us to provide our products to you in the best possible manner.  In addition, we may use the information for the following purposes:

  2. To fulfil or meet the reason you provided the information;

  3. To provide third parties with statistical information about the users of our Site;

  4. To monitor and conduct an analysis of our Site traffic and usage patterns;

  5. To administer reward and/or loyalty programs and promotions;

  6. To respond to law enforcement requests and as required by applicable law, court order or governmental regulations;

  7. To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Site users is among the assets transferred.

We will not use personal information we collected for materially different, unrelated, or incompatible purposes without providing you with notice and/or updating this Privacy Policy.

Security

To secure your information, we have put in place commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect on our Site.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.

Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically on our Site, and transmission of such data is therefore entirely at your own risk.

Disclosing Your Information  

Where applicable, we may disclose your personal information to any affiliated business entities or third parties necessary to provide products and/or services to you.  This includes, where applicable, our subsidiaries, our holding company and its other subsidiaries (if any), as well as third parties involved in the administration and operation of our products and/or services. We may also disclose your personal information to other third parties, such as:

  1. Where we sell any or all of our business and/or our assets to a third party, whether through bankruptcy proceedings or other sale or merger.
  2. Where we are legally required to disclose your information, including, but not limited to, pursuant to a valid subpoena, order, search warrant or other law enforcement request.
  3. To administer reward and/or loyalty programs and promotions. 
  4. When we are contractually obligated to disclose it.

Where we disclose personal information for a purpose set forth herein, we enter a contract with the third party that describes the purpose and requires the third-party recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We do not sell your personal information to third parties.

Third Party Websites

By accessing third party websites through our Site, you are consenting to the terms and privacy policies of those websites.  We do not accept any responsibility or liability for their policies whatsoever as we have no control over them.

Users Only of Legal Age of Majority

Our Site is designed and intended for those who have reached the age of majority (18 years of age). By using our Site, you affirm that you are at least 18 years of age or older.  We are not liable for any damages that may result from a user’s misrepresentation of age.

No one under age 13 is authorized to submit or post any information, including personally identifying information, on our Site. Under no circumstances may anyone under age 13 use our Site.  Parents or legal guardians of children under 13 cannot agree to these Terms on their behalf.

If our practices change, we will update this Privacy Policy and take any other necessary action to comply with applicable law.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time. Note that if you decide to delete your personal information, you may lose out on coupons and other targeted incentives that may save you money, such as our rewards and/or loyalty program. In order to keep these incentives, we must have access to your personal information. You can opt-in to these incentives by joining any applicable programs; however, if you request to have your personal information deleted via the methods listed above, you will no longer have access to these incentives.
